On August 12, 2024, the Cabinet of Ministers approved the Regulations on the procedure for pre-trial consideration of disputes in the field of urban planning. In accordance with this, an interdepartmental commission for pre-trial consideration and resolution of disputes in urban planning has begun its work under the Ministry of Construction and Housing and Communal Services.
The commission is empowered to directly examine urban planning documents and make decisions. As part of its work, it verifies the legality of documents such as architectural and planning assignments, resolutions of territorial architectural and urban planning councils, conclusions of the working bodies of these councils, as well as permits from territorial inspections for the registration of objects to commence construction and installation work.
"For example, a territorial administration or district construction department issued a permit for the construction of a certain object. However, for various reasons, this permit may not comply with our urban planning legislation, particularly if it was issued without considering the opinions of local residents. In such cases, the commission cancels the permit or conclusion," explained Azamat Kholmuninov, head of the State Architectural Control Department of the Ministry of Construction.
The commission operates throughout the republic. If a document complies with the legislation, it is sent for execution; if not, it is canceled.
