Three convictions, numerous violations, and administrative oversight: what else is known about the assistant to the Hokim of the Uchtepa district?

Recently, in the Uchtepa district of the capital, an assistant to the hokim was apprehended while accepting a bribe of $30,000. Kun.uz conducted an investigation into the identity of the official. According to the publication's findings, this civil servant had previously been accused of fraud, embezzlement, abuse of power, and document forgery, and had been convicted three times. Nevertheless, he has once again found himself within the executive branch.

A government official who served as an assistant to the hokim in one of the mahallas of the Uchtepa district was apprehended by law enforcement officers while receiving $30,000. He has been charged with fraud of especially large scale under paragraph "a" of part 4 of article 168 (Fraud in a particularly large amount) and paragraph "a" of part 3 of article 28,211 (Bribery) of the Criminal Code. The Mirzo-Ulugbek District Criminal Court has chosen to remand the civil servant in custody.

According to available information, the assistant hokim promised a citizen, who wanted to engage in entrepreneurial activities, that for $30,000 he would ensure victory at the auction and facilitate the registration of 210 square meters of land in the district, supposedly through his connections in high offices.

Who is this incognito assistant hokim?

The official information about the thrice-convicted individual, who worked in the civil service system, does not disclose his name, surname, or the mahalla in which he worked.

Kun.uz, relying on its own sources, has identified this individual as Bakhtiyor Doniyorovich Badalov, born in 1987, who served as an assistant hokim in the "Degrez" mahalla of the Uchtepa district.

There is no information in public sources regarding Badalov's previous places of employment.

According to information obtained by Kun.uz, Badalov has been convicted three times under articles 167, 168, 205, and others of the Criminal Code.

First conviction — 13 years in prison

Badalov was first convicted on July 8, 2011, by the Yunusabad District Court to 13 years of imprisonment.

He was found guilty of crimes related to official misconduct, including fraud, abuse of power or official authority, official forgery, document forgery, and legalization of proceeds from criminal activity. By the same sentence, he was deprived of the right to hold positions in public service for three years.

While serving his sentence, Badalov benefited from amnesties several times. By a ruling of the Mirishkor District Court of the Kashkadarya region on December 12, his sentence was reduced to 7 years and 7 months. Kun.uz does not know when exactly Badalov was released.

Second conviction — 14 years in prison

Bakhtiyor Badalov was convicted again on June 5, 2016, by the Tashkent City Court under the same articles. He was found guilty under paragraphs "a, b" of part 3 of article 167 (Theft by appropriation or embezzlement), paragraphs "a, b" of part 3 of article 25,168 (Fraud), paragraphs "a, b" of part 2 of article 209 (Official forgery), paragraph "a" of part 2 of article 227 (Destruction, damage, or concealment of documents), and paragraphs "a, b" of part 2 of article 228 (Document forgery). He was sentenced to 14 years in prison.

According to amnesty acts adopted from 2012 to 2014, his sentence was reduced by one quarter.

Third conviction — 2 years and 10 months in prison

In 2018, Badalov was convicted for the third time. This time he was charged with crimes related to fraud and official forgery. On January 19, 2018, the Tashkent City Criminal Court found him guilty of fraud, destruction or damage of documents, as well as official forgery. He was sentenced to 2 years and 10 months in prison, with a fine of 41,440,000 sums, and was barred from holding positions in public service for three years.

Administrative offenses

Bakhtiyor Badalov is known not only for his crimes but also for regularly committing administrative offenses.

Among them:

  • On July 18, 2019, he was fined under part 1 of article 187 of the Administrative Responsibility Code (Consumption of alcohol in public places).
  • On July 31, 2019 — fined under part 1 of article 192 (Violation of noise control requirements).
  • On September 2, 2020 — repeated violation under part 1 of article 192 (Violation of noise control requirements).
  • On September 18, 2020 — fined under part 1 of article 194 (Failure to comply with lawful demands of law enforcement officers).

Administrative supervision

Due to numerous violations, Bakhtiyor Badalov was placed under administrative supervision, according to a court ruling.

According to the decisions of the Uchtepa District Court from August 12, 2019, and October 13, 2020, after his release from prison, Badalov did not learn from his past and continued to lead an antisocial lifestyle.

He was repeatedly held administratively liable for consuming alcohol in public places, violating noise control requirements, and failing to comply with lawful demands of law enforcement officers. As a result, the court imposed administrative supervision twice for a period of 6 months, during which restrictions were placed on Badalov, including a ban on leaving home at certain times and visiting restaurants.

Appointment as assistant hokim

The exact date of Badalov's appointment as assistant hokim is unknown. However, based on open data , he took this position after August 14, 2023, as before that date, Zafar Yuldashev was listed as the assistant hokim in the "Degrez" mahalla.

Badalov's appointment to this position likely violates the law . According to article 28 of the Law "On Civil Service", adopted on August 8, 2022 (effective November 8, 2024), individuals convicted of corruption crimes or serious and particularly serious offenses cannot be employed in public service if their conviction has not been canceled or expunged.

Investigation

Currently, the Mirzo-Ulugbek District Prosecutor's Office is conducting an investigation against Bakhtiyor Badalov, who, being a thrice-convicted individual, is accused of committing another crime.

The question arises: how could a person, accused of fraud, embezzlement of property, official forgery, and document forgery, who has been convicted three times and spent no less than 5-6 years in places of deprivation of liberty, re-enter the system of public authority? Who and on what basis expressed trust in him?
