The Unified Portal of Interactive State Services has launched a service for enterprises to submit applications for pre-trial rehabilitation. This was reported by the press service of the website.
Pre-trial rehabilitation refers to measures aimed at restoring solvency and preventing the insolvency of the debtor. This procedure is provided for legal entities by the law "On Insolvency."
The service is available in the "Justice" section and is provided by the Agency for State Asset Management. During the rehabilitation period (up to 2 years), a special account is opened for the enterprise, which is not subject to seizures or automatic deductions.
Applications for pre-trial rehabilitation must be submitted before the bankruptcy procedure of the enterprise begins. The following documents must be attached:
- an act of reconciliation of the enterprise's tax liabilities;
- a copy of the approved business plan and debt repayment plan, as well as contracts confirming the need for the produced product;
- a copy of the decision (Tax Committee) on the deferment/installment of the tax debt;
- a copy of the statement from the servicing bank regarding the state of accounts and records;
- a copy of the agreement between the creditor and the debtor regarding the provision of a deferment/installment or discount on the loan.
The application review period is up to one month. The service is provided free of charge.
The Cabinet of Ministers approved the regulations for the service of accepting applications for judicial rehabilitation in October. According to these regulations, applications and other documents can also be submitted through the State Services Center.
